GENERAL TERMS AND CONDITIONS OF SALE – Commercial Headquarters

These general terms and conditions of sale govern all relations between:

and its internet customers (“The Customer”).

Before making any transaction, the customer acknowledges and accepts these conditions from the moment they click on the "I Accept" button.

1/ Specific conditions of sale

The customer acknowledges having read, at the time of placing the order, the specific terms and conditions of sale displayed on the screen (name, price of components, weight, quantity, color, product details, cost of services, etc.) and expressly declares their acceptance of them without reservation. Placing the order and its confirmation by the customer constitute full and complete acceptance of these specific terms and conditions of sale, which apply only to that order.

2/ Order

Somelar74 sl's automatic registration systems serve as proof of the nature, content, and date of the order.

3/ Order confirmation

Somelar74 sl confirms acceptance of your order to the customer via their preferred method: email, telephone, or postal mail. The sale will not be finalized until Somelar74 sl confirms the order.

Somelar74 sl reserves the right not to confirm an order for specific reasons such as product availability, a problem with the order received (e.g., illegible document), an unusual order, or a foreseeable delivery issue. Somelar74 sl will inform the customer.

No new orders can be placed until the customer has paid all outstanding amounts due for previous orders. Furthermore, ownership of the goods will not be fully transferred until Somelar74 sl has received payment from the customer.

4/ Order delivery conditions

The customer will choose the delivery location and date when placing the order. Somelar74 sl reserves the right to use all necessary means to deliver the products to the address provided by the customer. Deliveries will only be made within Spain (including the Balearic and Canary Islands). Shipments to the Canary Islands: By accepting these terms and conditions, the customer agrees to pay any applicable customs duties.

5/ Delivery times

Deliveries will be made within a maximum of 10 business days. If an item is out of stock at the time of ordering, we will notify you and confirm the date it will be back in stock or offer you an equivalent replacement product. Delivery costs are the responsibility of the recipient.

6/ Delivery and receipt costs of orders

When placing an order, the customer agrees to sign the delivery receipt presented by the delivery person, on which they may include any comments they deem necessary. By signing the delivery receipt, the customer acknowledges having received the number of packages indicated therein. If the customer notices damaged or missing products, they must file a complaint with Customer Relations by email or by mail to Somelar74 sl, Calle Aguacate, 16 Quinto_B 28044 Madrid (Spain), or by phone at 34 644 145 769 within a maximum of three days.

Any event such as force majeure, disaster, strike, administrative decision, or transport strike that delays, prevents, or makes supply prohibitively expensive constitutes, by express agreement, a clause for the suspension or termination of Somelar74 sl's obligations, without compensation to the customer if the event lasts for more than 15 days. In these circumstances, the customer will be fully and automatically released from their obligations regarding their order.

Somelar74 sl will inform the customer by any appropriate means and on the same day that the event occurs so that the customer can freely cancel their orders by replying by post or email once the event has been notified.

When the delivery of the goods to the customer cannot be made due to the latter, the company Somelar74 sl reserves the possibility of invoicing preparation costs which will be communicated to the customer in advance.

7/ Shipping company

Deliveries will be made by the transport company. DHL During normal business hours. Please select a shipping address where someone can receive the package.

8/ Price

All prices are shown in euros and include VAT. The price invoiced to the customer is the price indicated in the order confirmation sent by Somelar74 sl. Payment for products and services is made by credit card in a secure environment on our provider's server. The customer's credit card will be charged in euros two days after Somelar74 sl accepts the order. Somelar74 sl retains ownership of the products until the customer has paid the full price of the products and services.

9/ Product sheet

The photographs of the products are provided for illustrative purposes only. The accompanying text is a reproduction of information found on the packaging or in the instructions for use. Any differences between the photographs and the actual products will be minimal and will not affect the essential characteristics of the products. The color of the products shown in the online store may differ from the actual product color.

10/ Payment terms

The requested products will be delivered after payment by credit card (Master Card, Visa Card, American Express, JCB, Bank Transfer).

11/ Security of private information (National Commission for Information Technology and Freedom)

Somelar74 sl is obligated to protect your private information. The personal data collected during your connection to our website will only be used to process your order. We will not sell, rent, or disclose your personal data to any person (or third party).

12/ Requested information

By placing orders through the website www.somelar.es, you consent to Somelar74 sl using your personal data, whether provided by you or collected through the operation of the website. This data (name, email address, postal address, credit card number and expiry date, etc.) is necessary for us to process your orders.

13/ Security of personal data

Orders (containing your account information) are sent via a secure server. The security program (SSL) encrypts all the information you enter before it is sent to us. Furthermore, message transmissions are protected against unauthorized access by third parties.

14/ Warranty

The customer will benefit from the legal guarantee against hidden defects in the products sold. All our products are designed and manufactured with the utmost care. However, the guarantee will not be valid if failures or damage occur due to improper handling, lack of maintenance, or care contrary to our instructions for use. The buyer should consult the instructions and appropriate recommendations found in the user manual provided with the product.

15/ Right to resend the goods and withdrawal period

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire 14 days after the day on which you, or a third party indicated by you other than the carrier, acquires physical possession of the goods.

To exercise the right of withdrawal, you must notify us in writing (Somelar74 sl, Calle Aguacate, 16 Quinto_B 28044 Madrid (Spain), or by phone at 644-145-769 or by email at admin@somelar.es, providing your name, home address, telephone number, fax number and email address) of your decision to withdraw from the contract by means of an unequivocal statement (e.g., a letter sent by post, fax or email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, without undue delay and in any event no later than 14 days from the date on which we are informed of your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is the earliest.

You must return or deliver the goods to the same address from which the order was sent, without undue delay and, in any event, no later than 14 days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be considered met if you return the goods before the 14-day period has expired.

You will have to bear the direct cost of returning the goods.

You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

16/ Intellectual Property

When connecting to the website created by Somelar74 sl, the owner of all intellectual property rights thereto, the client may not copy or download all or part of its content without prior and express authorization from Somelar74 sl.
